INTRODUCTION

The term ‘coaching’ as here used covers Marshall Goldsmith Stakeholder Centered Leadership coaching, executive coaching, business coaching, life and personal coaching or mentoring for clients. 

Simon Haigh and associated coaches or mentors within GCM Consulting Ltd, ExpertDealCloser.com and SimonHaigh.com, herein referred to as “the Coach” are representing GCM Consulting Ltd, expertdealcloser.com and SimonHaigh.com. Before engaging the services of the Coach, you are hereby accepting that you have read, understood and are willing to comply with the terms and conditions as detailed below, before proceeding.

RESPONSIBILITIES 

​

The Coach will seek to enable the client to improve their level of business success and/or quality of life and to achieve their desired outcomes. Powerful results can be achieved where clients follow a clear plan in a fully committed way. However, the client has sole responsibility for taking the actions prescribed by the Coach. Neither the Coach nor GCM Consulting Ltd, expertdealcloser.com nor SimonHaigh.com have any liability for any loss or damage incurred by any client, whether financial or otherwise, following commencement of coaching sessions, or for any perceived failure by the client, whether justified or otherwise, to achieve a material improvement in quality of life or business or to achieve their desired outcomes or goals.

COMMUNICATION

​

All coaching services and communication, email or otherwise, delivered by the Coach, as well as information on this website (simonhaigh.com, expertdealcloser.com or gcmadvisory.com) or any associated social media channels are intended to help the client identify the areas in their leadership, executive, business or personal lives and in their thinking that may be preventing them from experiencing greater well-being or growth.

COACHING SESSION FORMATS 

 

The date and time of the first coaching session and any subsequent coaching session shall be agreed between the Coach and the client by email or equivalent electronic message and confirmed by the Coach in the same way. The length of each coaching session shall be agreed between the Coach and the client before coaching sessions commence.  Coaching sessions will be via face to face (venue by mutual agreement), Zoom or equivalent format as agreed.

 

 

COACHING SESSION FEES & PAYMENT TERMS

 

The coaching schedule will be arranged between the Coach and the client and can be booked up to 1 calendar month in advance. The Coach will recommend the frequency of coaching sessions based on a professional assessment of the client’s requirements. This recommended plan is not binding and may be altered and adjusted throughout the coaching journey by mutual agreement, in accordance with the terms set out in this agreement. 

The number and frequency of coaching sessions will be agreed at the start of coaching program between the Coach and the client, and confirmed by the Coach by email or equivalent. Where no specific number is agreed sessions will be provided on a session by session basis. 

In return for the fees payable by the client, the Coach agrees to provide the service as described herein and in accordance with the terms and conditions set out herein. The client agrees to pay the fees for the service on the terms and conditions set out herein. The Coach will agree with the client, then confirm the fees in writing, usually by email to the client. The number of sessions for which payment is required in advance will be agreed before coaching sessions commence. Fees can be paid online by debit or credit card or by bank transfer. Where receipts are requested by the client, they will be sent by e-mail unless otherwise requested. Where payment has not been received by the Coach in advance of a coaching session the Coach is not obliged to provide the session unless otherwise agreed in advance. 

Where any client is unhappy with any of the terms and conditions, they can contact the Coach to discuss any concerns and see if they can be resolved before the first coaching session. Participation by any individual in the first coaching session constitutes acceptance of these terms and conditions.

BETWEEN SESSIONS

The Coach may assign the client tasks or exercises to complete between coaching sessions. There is no obligation on the client to complete these items of ‘homework’, but not doing so may slow the client’s progress in gaining improved business personal outcomes. 

 

 

RESCHEDULING SESSIONS & VARIATION

 

If a client needs to rearrange a coaching session, they should provide at least 48 hours’ notice. No refunds will be given to clients for unused coaching sessions unless 48 hours’ notice has been given. In exceptional circumstances the Coach may need to rearrange a coaching session. In those instances, he will also give the client 48 hours’ notice where practical. 

 

 

CONFIDENTIALITY & LEGAL

 

I hereby release, waive, acquit and forever discharge the Coach, any agents, successors, assigns, personal representatives, executors, heirs and employees from every claim, suit, action, demand or right to compensation for damages I may claim to have or that I may have arising out of acts or omissions by myself or by the Coach as a result of the advice given by the Coach or otherwise resulting from the coaching relationship contemplated by this agreement. 

Personal and/or business information supplied by clients in coaching sessions will be treated as confidential. It will not be disclosed to a third party without the client’s prior permission, save where required by law or where action might be necessary to prevent harm to the client or someone else. However, I understand that the use of technology is not always secure and I accept the risks of confidentiality in the use of email, text, phone, Skype, Zoom and all other technology. 

In exceptional circumstances, such as illness or unavailability due to bereavement or other commitments, inappropriate behaviour by the client, actual or potential conflict of interest, or other reasons, the Coach can decide to terminate the service to the client early or refuse or be unable to provide further coaching sessions to the client. In such a circumstance the client will be given reasonable notice of termination by the Coach where practicable and will be refunded any advance payments made for coaching sessions not yet provided. 

 

 

FEEDBACK 

 

The Coach is constantly striving to ensure the highest of standards of service provided to clients. At the end of each coaching process, the client will be asked to complete a feedback form. In any event, feedback about the coaching is welcome at any times and can be given during a coaching session or by writing to Simon Haigh at simon@simonhaigh.com.

 

 

DISCLAIMER 

 

I understand and agree that I am fully responsible for my own well-being and commitment during my coaching sessions, and subsequently, including my own choices and decisions. I also understand that the coaching services received from the Coach are not a substitute for counselling, psychotherapy, psychoanalysis, mental health care or medical treatment or equivalent, and I will not use it in place of any such alternative forms of treatment.

I understand that all suggestions, comments and propositions offered by my Coach are solely for the purpose of aiding me in achieving the defined goals I create with my Coach. I have the ability to give my informed consent, and hereby give such consent to my Coach to assist me in achieving such goals and understand that results are not guaranteed. 

For legal purposes, I understand that coaching is currently an unregulated industry and that my Coach is not “licensed “ by any UK, Irish or other territory body (other than being an associate member and certified coach of the Marshall Goldsmith Stakeholder Centered Coaching Organisation) even though the sessions may take place in Ireland, the UK or via electronic mediums. 

 

 

GOVERNING LAW 

 

This contract is governed by the law of Ireland whose courts have exclusive jurisdiction in relation to any dispute, disagreement, proceedings or legal claim of any nature relating to these terms and conditions.
